User agreement

 

Please read carefully and fully understand the contents of each clause, especially the exemption or limitation of liability.When you use the software, you read and agree to all terms.If you are under 18, please read with your guardian.

 

1、 Scope of agreement: this agreement is a direct agreement between the user who installed the software and the software, and "you" or "you" below refers to the user

 

2、 Product service

2. Service form

 

To use this service, you need to download client software. For these software, movie selection gives you a personal, non transferable and non exclusive license.You may use these software and services only for the purpose of accessing or using the service.

 

3. Service scope

 

(1) The selection gives you a personal, non transferable and non exclusive license to use the software.You can install, use, display and run the software on a single terminal device for non-commercial purposes.

 

(2) A copy of the software and the software may be used for your backup purposes only.The backup copy must contain all intellectual property information contained in the original software.

 

(3) All other rights not explicitly authorized by this article and other provisions of this Agreement are still reserved by TV select, and you need to obtain the written permission of TV select to exercise these rights.The failure to exercise any of the above rights does not constitute a waiver of such rights.

 

3、 Acquisition of software

 

You can obtain it from a third party authorized by the film and television selection.If you have never obtained the software or the installation program with the same name as the software from a third party authorized by movie and television select, the software can not be guaranteed to work normally, and will not be responsible for the losses caused to you.

 

4、 Installation and removal of software

 

1. Different software versions may be developed for different terminal devices. You should download the appropriate version for installation according to the actual situation.

 

2. After downloading the installation program, you need to follow the steps prompted by the program to install correctly.

 

3. In order to provide more high-quality and safe services, we may recommend you to install other software when installing the software. You can choose to install or not to install.

 

4. If you no longer need to use the software or need to install a new version of the software, you can uninstall it yourself.If you are willing to help improve the product and service, please tell us the reason for the removal.

 

5、 Software update

2. In order to ensure the security and function consistency of the software and services, the film and television selection has the right to update the software without special notice to you, or change or limit the partial function effect of the software.

 

3. After the new version of the software is released, the old version of the software may not be used.There is no guarantee that the old version software will continue to be available and provide corresponding customer service. Please check and download the latest version at any time.

 

6、 Protection of user's personal information

7、 Precautions for users

4. You understand and agree that TV select will use its reasonable commercial efforts to ensure the security of your data storage in the software and services. However, TV selection can not provide full guarantee in this regard, including but not limited to the following situations:

 

(1) . TV select is not responsible for the deletion or storage failure of relevant data in the software and services;

 

(2) . if you stop using the software and services, or if the service is terminated or cancelled, TV select can permanently delete your data from the server. After the service is stopped, terminated or cancelled, TV select has no obligation to return any data to you.

 

5. You understand and agree that when using the software and services, you shall bear the following uncontrollable risks, including but not limited to:

 

(1) . personal information loss, leakage and other risks that may be caused by irresistible factors;

 

(2) The user must select the software version matching the installed equipment, otherwise, any problems or damages caused by the mismatch between the software and the equipment model shall be borne by the user;

 

(3) When users use the software to visit the third-party website, the risk caused by the third-party website and related content shall be borne by the user;

 

(4) . the risks and responsibilities that may be brought about by the dissemination of the content released by users are forwarded and shared by others;

 

(5) Due to the slow speed of the login, the network bandwidth is not stable, etc.

 

6. You understand and agree as follows:

 

(1) In the process of providing services, the selection of films and TV can send you advertising, promotion or promotional information (including commercial and non-commercial information) by itself or by a third-party advertiser to you in the process of providing services, and its mode and scope may be changed without special notice to you.

 

(2) . TV selection may provide you with the function of closing advertising information, but you shall not block or filter advertising information in any way not explicitly agreed in this agreement or without written permission.

 

(3) In accordance with the provisions of the law, film and television selection shall perform relevant obligations to the advertisers. You shall judge the authenticity of the advertising information and be responsible for your own judgment behavior. Unless otherwise specified by law, the film and television selection shall not be liable for any loss or damage suffered by you due to the transaction conducted in accordance with the advertising information or the content provided by the above-mentioned advertisers.

 

(4) You should carefully judge the authenticity and reliability of the advertising information in the film and television selection service, and you should be responsible for the transactions based on the advertising information, except as clearly stipulated by law.

 

7. You understand and agree as follows:

 

(1) Some of the services are provided by charging. If you use the charging service, please abide by the relevant agreement.

3. Software specification

 

You are not allowed to engage in any of the following activities except with the written permission of the selection:

 

(1) Delete copyright information on the software and its copies;

 

(2) Reverse engineer, reverse assemble, reverse compile the software, or try to find the source code of the software in other ways;

 

(3) To use, rent, lend, copy, modify, link, reprint, assemble, publish, publish, and establish a mirror site for the selected film and television content with intellectual property rights;

4. Be responsible for your actions

5. Breach of contract

9、 Intellectual property declaration

3. The copyright or trademark right of the commercial logo such as film and television selection used in this service belongs to the film and television selection.

 

4. The intellectual property rights of the above and any other content contained in this service are protected by law. No one may use or create related derivative works in any form without the written permission of film and television selection, users or relevant right holders.

 

10、 Terminal security responsibility

Film and television selection will reasonably and prudently take necessary technical measures to protect the information and data security of your terminal equipment in accordance with the industry standards. However, you acknowledge and agree that film and television selection can not provide security guarantee for this.

 

11、 Third party software or technology

 

1. The software may use third-party software or technology (including open source code and public domain code that may be used by the software, the same below), and such use has been legally authorized.

 

2. If the software uses the software or technology of a third party, the film and television selection will display the relevant agreements or other documents in the form of attachments to this agreement, packaging in the specific folder of the software installation package, etc. according to relevant laws and regulations, they may be displayed in the form of "software use license agreement", "License Agreement", "open source code license" or other formsTo express.The above-mentioned relevant agreements or other documents in various forms are an integral part of this Agreement and have the same legal effect as this agreement. 12、 Others

 

1. By using the software, you shall be deemed to have read and agreed to be bound by this agreement.Film and television select has the right to modify the terms of this agreement if necessary.You can refer to the terms of the agreement in the latest version of the software.After the terms of this Agreement are changed, if you continue to use the software, you will be deemed to have accepted the modified agreement.If you do not accept the modified agreement, you should stop using the software.

 

2. This agreement is signed in Chaoyang District, Beijing, people's Republic of China.

 

3. The establishment, effectiveness, performance, interpretation and dispute settlement of this Agreement shall be governed by the laws of the mainland of the people's Republic of China (excluding conflict law).

 

4. If there is any dispute or dispute between you and the selected film and TV series, you should first settle it through friendly negotiation; if the negotiation fails, you agree to submit the dispute or dispute to the people's court with jurisdiction in the place where this agreement is signed.

 

5. The headings of all clauses in this Agreement are for convenience of reading only and have no actual meaning, so they cannot be used as the basis for interpretation of the meaning of this agreement.

 

6. The provisions of this Agreement are partially invalid or unenforceable for any reason, and the remaining provisions are still valid and binding on both parties.

2.服务形式

您使用本服务需要下载客户端软件，对于这些软件，影视精选给予您一项个人的、不可转让及非排他性的许可。您仅可为访问或使用本服务的目的而使用这些软件及服务。

3.服务范围

(1) 影视精选给予您一项个人的、不可转让及非排他性的许可、以使用本软件。您可以为非商业目的在单一台终端设备上安装、使用、显示、运行本软件。

(2) 您可以为使用本软件及服务目的复制本软件的一个副本，仅用作备份。备份副本必须包含原软件中含有的所有知识产权信息。

(3) 本条及本协议其他条款未明示授权的其他一切权利仍由影视精选保留，您在行使这些权利时须另外取得影视精选的书面许可。影视精选如果未行使前述任何权利，并不构成对该权利的放弃。

三、软件的获取

您可以从得到影视精选授权的第三方获取。如果您从未经影视精选授权的第三方获取本软件或与本软件名称相同的安装程序，影视精选无法保证该软件能够正常使用，并对因此给您造成的损失不予负责。

四、软件的安装与卸载

1.影视精选可能为不同的终端设备开发了不同的软件版本，您应当根据实际情况选择下载合适的版本进行安装。

2.下载安装程序后，您需要按照该程序提示的步骤正确安装。

3.为提供更加优质、安全的服务，在本软件安装时影视精选可能推荐您安装其它软件，您可以选择安装或不安装。

(1).影视精选不对您在本软件及服务中相关数据的删除或存储失败负责；

(2).如果您停止使用本软件及服务或服务被终止或取消，影视精选可以从服务器上永久地删除您的数据，服务停止、终止或取消后，影视精选没有义务向您返还任何数据。

5.您理解并同意，在使用本软件及服务时，须自行承担如下不可掌控的风险内容，包括但不限于：

(1).由于不可抗拒因素可能引起的个人信息丢失、泄露等风险；

(2).用户必须选择与所安装设备相匹配的软件版本，否则，由于软件与设备型号不匹配所导致的任何问题或损害，均由用户自行承担；

(3).用户在使用本软件访问第三方网站时，因第三方网站及相关内容所可能导致的风险，由用户自行承担；

(4).用户发布的内容被他人转发、分享，因此等传播可能带来的风险和责任；

(5).由于网络信号不稳定、网络带宽小等原因，所引起的本软件登录失败、资料同步不完整、页面打开速度慢等风险。

6.您理解并同意如下：

(1).影视精选可以在提供服务的过程中自行或由第三方广告商向您发送广告、推广或宣传信息（包括商业与非商业信息），其方式和范围可不经向您特别通知而变更。

(2).影视精选可能为您提供选择关闭广告信息的功能，但任何时候您都不得以本协议未明确约定或影视精选未书面许可的方式屏蔽、过滤广告信息。

(3).影视精选依照法律的规定对广告商履行相关义务，您应当自行判断广告信息的真实性并为自己的判断行为负责，除法律明确规定外，您因依该广告信息进行的交易或前述广告商提供的内容而遭受的损失或损害，影视精选不承担责任。

(4).对影视精选服务中出现的广告信息，您应审慎判断其真实性和可靠性，除法律明确规定外，您应对依该广告信息进行的交易负责。

7.您理解并同意如下：

(1).影视精选的部分服务是以收费方式提供的，如您使用收费服务，请遵守相关的协议。

(2).影视精选可能根据实际需要对收费服务的收费标准、方式进行修改和变更，影视精选也可能会对部分免费服务开始收费。前述修改、变更或开始收费前，影视精选将在相应服务页面进行通知或公告。如果您不同意上述修改、变更或付费内容，则应停止使用该服务。

八、用户行为规范

1.账号使用规范

(1)您在使用本软件及服务的观看、缓存、订阅、收藏、评论、分享、云同步等功能时可能需要登陆账号体系。

(2)用户有责任妥善保管注册账户信息及账户密码的安全，用户需要对注册账户及密码下的行为承担法律责任。用户同意在任何情况下不向他人透露账户及密码信息。在您怀疑他人在使用您的账号时，您应按照影视精选公司提供的方式找回密码。

2.信息内容规范

(1)您可使用本软件及服务发表属于您原创或您有权发表的观点看法、文字、信息、用户名、图片、照片、个人照片、个人信息、链接等信息内容。您必须保证，您拥有您所上传信息内容的知识产权或已获得合法授权，您使用本软件及服务的任何行为未侵犯任何第三方之合法权益。

(2)您在使用本服务时不得利用本服务从事以下行为，包括但不限于：

i.发布、传送、传播、储存违反国家法律、危害国家安全统一、社会稳定、公序良俗、社会公德以及侮辱、诽谤、淫秽或含有任何性或性暗示的、暴力的内容；

ii.发布、传送、传播、储存侵害他人名誉权、肖像权、知识产权、商业秘密等合法权利的内容；

iii.发布、传送、传播、储存涉及他人隐私、个人信息或资料的；

iv.发表、传送、传播骚扰、广告信息及垃圾信息；

v.其他违反法律法规、政策及公序良俗、社会公德或干扰视频正常运营和侵犯其他用户或第三方合法权益内容的信息。

3.软件使用规范

除非影视精选书面许可，您不得从事下列任一行为：

（1）删除软件及其副本上关于著作权的信息；

（2）对软件进行反向工程、反向汇编、反向编译，或者以其他方式尝试发现软件的源代码；

（3）对影视精选拥有知识产权的内容进行使用、出租、出借、复制、修改、链接、转载、汇编、发表、出版、建立镜像站点等；

（4）对软件或者软件运行过程中释放到任何终端内存中的数据、软件运行过程中客户端与服务器端的交互数据，以及软件运行所必需的系统数据，进行复制、修改、增加、删除、挂接运行或创作任何衍生作品，形式包括但不限于使用插件、外挂或非经影视精选授权的第三方工具/服务接入软件和相关系统；

（5）通过修改或伪造软件运行中的指令、数据，增加、删减、变动软件的功能或运行效果，或者将用于上述用途的软件、方法进行运营或向公众传播，无论这些行为是否为商业目的；

（6）通过非影视精选开发、授权的第三方软件、插件、外挂、系统，登录或使用影视精选软件及服务，或制作、发布、传播非影视精选开发、授权的第三方软件、插件、外挂、系统；

（7）自行或者授权他人、第三方软件对本软件及其组件、模块、数据进行干扰；

（8）其他未经影视精选明示授权的行为。

4.对自己行为负责

您充分了解并同意，您必须为自己使用本软件及服务的一切行为负责，包括您所发表的任何内容以及由此产生的任何后果。您应对本服务中的内容自行加以判断，并承担因使用内容而引起的所有风险，包括因对内容的正确性、完整性或实用性的依赖而产生的风险。影视精选无法且不会对因前述风险而导致的任何损失或损害承担责任。

5.违约处理

如果影视精选发现或收到他人举报或投诉您发布的信息违反本条约定，影视精选有权进行独立判断并采取技术手段予以删除、屏蔽或断开链接。同时，影视精选有权视用户的行为性质，违规账号对采取包括但不限于警告、限制或禁止使用，追究法律责任等措施。

您违反本条约定，导致任何第三方损害的，您应当独立承担责任；影视精选因此遭受损失的，您也应当一并赔偿。

九、知识产权声明

1.影视精选在本服务中提供的内容（包括但不限于网页、文字、图片、音频、视频、图表等）的知识产权归影视精选或相关权利人所有(A.视频内容来源：①YouTube且符合API使用②互联网公开引用资源③符合互联网无限制共享的资源内容B.所有内容都来自外部采集，若其中内容涉及到您的权力，请联系，我们会在查看到信息的第一时间，屏蔽删除相关内容C.本应用为非盈利应用，仅供学习测试)，用户在使用本服务中所产生的内容的知识产权归用户或相关权利人所有。

2.除另有特别声明外，影视精选提供本服务时所依托软件的著作权、专利权及其他知识产权均归影视精选所有。

3.影视精选在本服务中所使用影视精选等商业标识，其著作权或商标权归影视精选所有。

4.上述及其他任何本服务包含的内容的知识产权均受到法律保护，未经影视精选、用户或相关权利人书面许可，任何人不得以任何形式进行使用或创造相关衍生作品。

十、终端安全责任

1.您理解并同意，本软件同大多数互联网软件一样，可能会受多种因素影响，包括但不限于用户原因、网络服务质量、社会环境等；也可能会受各种安全问题的侵扰，包括但不限于他人非法利用用户资料，进行现实中的骚扰；用户下载安装的其它软件或访问的其他网站中可能含有病毒、木马程序或其他恶意程序，威胁您的终端设备信息和数据安全，继而影响本软件的正常使用等。因此，您应加强信息安全及个人信息的保护意识，注意密码保护，以免遭受损失。

2.您不得制作、发布、使用传播用于窃取视频账号及他人个人信息、财产的恶意程序。

3.维护软件安全与正常使用是影视精选和您的共同责任，影视精选将按照行业标准合理审慎地采取必要技术措施保护您的终端设备信息和数据安全，但是您承认和同意影视精选并不能就此提供安全保证。

十一、第三方软件或技术

1.本软件可能会使用第三方软件或技术（包括本软件可能使用的开源代码和公共领域代码等，下同），这种使用已经获得合法授权。

2.本软件如果使用了第三方的软件或技术，影视精选将按照相关法规或约定，对相关的协议或其他文件，可能通过本协议附件、在本软件安装包特定文件夹中打包等形式进行展示，他们可能会以“软件使用许可协议”、“授权协议”、“开源代码许可证”或其他形式来表达。前述通过各种形式展现的相关协议或其他文件，均是本协议不可分割的组成部分，与本协议具有同等的法律效力，您应当遵守这些要求。如果您没有遵守这些要求，该第三方或者国家机关可能会对您提起诉讼、罚款或采取其他制裁措施，并要求影视精选给予协助，您应当自行承担法律责任。

十二、其他

1.您使用本软件即视为您已阅读并同意受本协议的约束。影视精选有权在必要时修改本协议条款。您可以在本软件的最新版本中查阅相关协议条款。本协议条款变更后，如果您继续使用本软件，即视为您已接受修改后的协议。如果您不接受修改后的协议，应当停止使用本软件。

2.本协议签订地为中华人民共和国北京市朝阳区。

3.本协议的成立、生效、履行、解释及纠纷解决，适用中华人民共和国大陆地区法律（不包括冲突法）。

4.若您和影视精选之间发生任何纠纷或争议，首先应友好协商解决；协商不成的，您同意将纠纷或争议提交本协议签订地有管辖权的人民法院管辖。

5.本协议所有条款的标题仅为阅读方便，本身并无实际涵义，不能作为本协议涵义解释的依据。

6.本协议条款无论因何种原因部分无效或不可执行，其余条款仍有效，对双方具有约束力。
